"breathalyzer" for texting

Not saying I disagree with the concept, but my gut reaction is that one will go to the Supreme Court unless the cops have a search warrant.

I'm have mixed feelings about this, too. I would agree that they would need a warrant to examine any files or emails or the browser history on your phone. But a simple test that determines whether you were or were not texting at a certain time?

Interestingly enough, the Supreme Court has just within the last year upheld the Constitutionality of breathalyzer testing, but they definitely need a warrant to compel a blood test.
